General Terms and Conditions
Preliminary remark:
Generation X GmbH is commissioned by the diving centres to process all bookings/orders made via this website. In the case of individual services (in particular diving packages and courses), Generation X GmbH acts solely as our agent.
Package tours are arranged or organised by Lagona Travel GmbH. The following terms and conditions of Lagona Travel GmbH apply to these arrangements and organisations. Your booking is subject to the current terms and conditions of Lagona Travel GmbH valid at the time of the offer and sent with the confirmation at the latest.
These terms and conditions are a translation of the valid travel conditions from German. In case of doubt, the original wording in German shall apply.
Travel conditions of Lagona Travel GmbH
Status: 10 July 2025
These travel conditions summarise all the important provisions of your travel contract. Please read the conditions carefully – they help us to make your trip as smooth as possible.
1. Scope of application and contracting parties

These terms and conditions apply to all package tours and partial package tours as well as to additional services (e.g. transfers, excursions) booked with Lagona Travel GmbH. Any deviating agreements are only valid if we confirm them in writing.
2. Dynamic packaging
2.1 Dynamic packaging:
All trips are dynamically configured as a package at the time of booking. Individual services (flight, hotel, transfer, etc.) are added on a daily basis. As a result, the cancellation and rebooking conditions for individual components may vary (see sections 6 and 7).
2.2 Arranging third-party package tours:
If we arrange a package tour from another operator, we act exclusively on behalf of and for the account of that operator. Lagona Travel GmbH is solely responsible for collecting and forwarding your payments to the operator named in the booking confirmation.
2.3 Additional services via Lagona Travel GmbH:
If you book additional services (e.g. diving packages, excursions) directly with Lagona Travel GmbH for a package tour arranged by us, our own terms and conditions apply to these services. Payment is made directly to Lagona Travel GmbH.
2.4 Pure diving services as a processor:
If you book only diving services from the “Lagona Divers” brand (packages, courses, equipment rental), we will handle the entire process on behalf of the diving centre (e.g. booking confirmation, payment processing, voucher creation). These services are subject to the diving centre’s terms and conditions, supplemented by our processing rules. As a vicarious agent, we forward your payments to the service provider.
3. Obligations of the traveller to cooperate
We kindly request your assistance to ensure that your journey runs smoothly:
Travel documents & health: Ensure that you have a valid passport, visas and any necessary vaccinations or certificates in good time. You will be responsible for any costs and disadvantages incurred if you do not have the required documentation.
Insurance: We recommend taking out travel cancellation and travel health insurance, as well as decompression chamber insurance for diving trips.
Unused services: Services that are not used (e.g. excursions) are not eligible for a refund.
Participation requirements: For sports and diving packages, health and technical requirements must be met (e.g. medical certificate, diving certificate). If these requirements are not met, the service will not be provided and there will be no entitlement to a refund.
4. Payments & Insolvency Protection
4.1 Deposit & balance payment
Deposit: 20% of the tour price upon booking
Balance: no later than 30 days before departure
4.2 Different deposits
For certain services (e.g. charter flights, high season, group travel, immediately issued flight tickets, special trips), a higher deposit may be required. Please refer to your booking confirmation for details.
4.3 Insolvency protection (§ 651r BGB)
Your payments are legally secured. In the event of insolvency, we will refund all payments made and, if agreed, guarantee return transport and accommodation.
5. Force majeure
Events beyond our control (e.g. natural disasters, epidemics, political unrest) temporarily release us from our obligation to provide services. We will inform you immediately and endeavour to find replacement or rebooking options. Claims for damages are excluded.
6. Price adjustment & price reduction
6.1 Price adjustment (§ 651f BGB):
We may pass on cost increases (e.g. fuel prices, taxes) up to 20 days before the start of the trip – information will be provided in writing.
6.2 Price reduction:
If costs specified after conclusion of the contract decrease, the travel price shall be reduced accordingly.
6.3 Withdrawal in the event of a price increase (Section 651g of the German Civil Code (BGB)):
If the travel price increases by more than 8%, you may withdraw from the contract free of charge.
7. Changes to bookings & substitutes
7.1 Rebooking:
You can change names, travel dates or services up to 20 days before departure. We charge a rebooking fee of €60 per person. Directly issued flight tickets are often non-rebookable; in this case, you will bear the rebooking costs.
7.2 Replacement person (§ 651e BGB):
You may name a replacement person up to 7 days before the start of the trip. Your nomination shall be deemed timely if it reaches Lagona Travel GmbH in writing by this date. The original traveller and the replacement person shall be jointly and severally liable. Fees and costs are based on the cancellation scale (Section 8) and are calculated proportionally according to the time of notification; avoided expenses and possible revenues are taken into account. If a service provider (e.g. airline) refuses to change the name, the cancellation conditions in Section 8 apply.
8. Withdrawal & cancellation fees
You may withdraw from the contract at any time prior to commencement of travel. Depending on the type of booking and the time of withdrawal, the following compensation fees apply in relation to the travel price:
8.1 Packages with flights

8.4 Different & dynamic cancellation conditions
As trips are packaged dynamically, the cancellation conditions for individual third-party services may differ from the flat rates. You will receive all component-specific cancellation deadlines and costs when booking; pro-rata cancellation costs are shown transparently. The statutory maximum values of the Package Travel Terms and Conditions Regulation (§ 5) remain paramount, unless there are mandatory deviating third-party service clauses.
8.5 Extraordinary withdrawal (Section 651h BGB)
In exceptional circumstances (e.g. natural disasters, political unrest), you may withdraw free of charge.
9. Changes to services & defects
9.1 Before departure:
Minor changes (e.g. flight times, hotel category, excursions) are permitted if the overall quality is not affected. We will inform you immediately.
9.2 During the trip:
1. Notification of defects: Report any noticeable defects immediately on site or to our service hotline.
2. Remedy: We will immediately arrange for rectification or equivalent replacement.
3. Price reduction: If no remedy is possible, you can demand an appropriate price reduction.
4. Self-remedy: Only in urgent cases may you have defects remedied yourself and receive reimbursement of reasonable costs.
If you fail to report defects in a timely manner, your claims will expire.
10. Liability
We are liable in accordance with statutory provisions. For property damage and financial loss, only in cases of intent or gross negligence. In cases of simple negligence, only in cases of breach of essential obligations.
11. Limitation period
Claims for defects expire two years after the end of the trip. All other claims expire one year after the damage becomes known.
12. Final provisions
12.1 Place of performance & place of jurisdiction:
The place of performance and place of jurisdiction is the registered office of Lagona Travel GmbH.
12.2 Applicable law:
German law applies; the UN Convention on Contracts for the International Sale of Goods does not apply.
12.3 Severability clause: Should any provision be invalid, the remainder of the contract shall remain valid. It shall be replaced by a provision that comes closest to the economic purpose.
